ALL KINDERGARTEN THRU 12th GRADE SCHOOLS, INCLUDING PUBLIC, PRIVATE, CHURCH, CHARTER AND OTHER SCHOOLS, MUST COMPLY WITH FEDERAL OR STATE ASBESTOS REGULATIONS AT 40 CFR 763, SUBPART E

THE ONLY EXEMPTION FROM THIS FEDERAL REGULATION FOR THESE SCHOOLS IS “FOR PROFIT STATUS”.

Since most schools are organized as “not-for-profit” under the IRS code, the following federal asbestos regulation would generally apply to most schools in the U.S., except colleges and universities.

AHERA (Asbestos Hazard Emergency Response Act), a federal regulation, requires that all schools (public and private, k – 12, not for profit): (1) Assume the presence of asbestos in building materials, (2) conduct an inspection to prove the absence of asbestos, (3) develop, implement and follow an asbestos management plan, and (4) maintain records as required.

CHARTER SCHOOLS ARE NOT EXEMPT!

All schools must have a comprehensive asbestos inspection.

All schools must have an Asbestos Management Plan.

A trained “Designated Person” must manage the asbestos program. Having no program is not a legal option.

All maintenance and custodial personnel that merely work in a building that contains asbestos must be trained in a 2-hour Awareness class. All those who may disturb asbestos must have an additional 14 hours of training (16 hours total - Operations and Maintenance). Both OSHA and EPA compliance depend on these training requirements.

The Asbestos Institute does not conduct asbestos inspections or do asbestos work commercially.  We are a U.S. EPA Accredited Training Center serving as a resource to both the regulating and regulated communities.

Non-compliance is not an affordable choice.
